1. Acceptance of Terms

By accessing and using PersonaWise and its services ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this Service. These Terms of Service constitute a legally binding agreement between you and Lytle Solutions LLC ("Company," "we," "us," or "our").

2. Description of Service

PersonaWise is an AI-powered self-reflection and personal growth platform. The Service creates AI personas based on the user's life experiences across developmental stages, provides therapeutic-principle-guided conversations, and offers tools including journaling, self-care checklists, and AI wellness coaching. The specific features available may vary based on your subscription plan.

3. User Accounts

To use certain features of the Service, you must register for an account. When you register for an account, you agree to:

Provide accurate, current, and complete information
Maintain and update your information to keep it accurate and complete
Maintain the security of your account credentials
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

4. Subscription and Payment

Some aspects of our Service are provided on a subscription basis (Reflect, Grow, and Thrive tiers). By subscribing, you agree to:

Pay all applicable fees as described in our pricing plans
Provide current, complete, and accurate billing information
Authorize us to charge your payment method on a recurring basis
Be responsible for all charges incurred under your account

New users receive a 3-day free trial with full access. Subscription fees are non-refundable except as required by law. We reserve the right to change our subscription plans or adjust pricing with 30 days' notice.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

PersonaWise is a self-reflection and personal growth tool, NOT a medical device, therapy service, or mental health treatment platform
AI-generated persona conversations and therapeutic insights are NOT a substitute for professional therapy, counseling, psychiatric treatment, or medical advice
The "AI Therapist" feature (Dr. Sarah and Dr. James) provides AI wellness coaching based on therapeutic principles (CBT, DBT, ACT) but is NOT delivered by licensed professionals
No doctor-patient, therapist-client, or other professional relationship is created through use of this Service
You should always consult a licensed mental health professional for serious mental health concerns, diagnoses, or treatment plans

6. Confidentiality & Trade Secrets (NDA)

You acknowledge that PersonaWise contains proprietary and confidential information constituting trade secrets of Lytle Solutions LLC. This includes, without limitation:

App features, user interface designs, and user experience flows
AI persona frameworks, generation methodologies, and therapeutic validation systems
Developmental psychology-based onboarding question flows and structured assessment frameworks
AI prompt engineering, system prompt architectures, and response validation layers
Crisis detection algorithms and safety intervention systems
Data encryption and zero-knowledge privacy architecture designs

By using the Service, you agree to the following non-disclosure obligations:

You will NOT disclose, publish, or share proprietary features, methodologies, or technology with any third party for competitive purposes
You will NOT screenshot, record, or document the Service for the purpose of replicating, reverse-engineering, or creating derivative works
You will NOT reverse-engineer, decompile, disassemble, or extract any proprietary technology, algorithms, AI prompts, or source code from the Service
You will NOT use knowledge gained from the Service to create, develop, advise, or contribute to any competing product or service for a period of 24 months after your last use of the Service

These trade secrets are protected under the California Uniform Trade Secrets Act (Cal. Civ. Code §3426 et seq.) and the Arizona Uniform Trade Secrets Act (A.R.S. §44-401 et seq.). Any violation of this section shall entitle Lytle Solutions LLC to seek injunctive relief, actual damages, and attorney's fees in the state or federal courts of California or Arizona, at the Company's election.

7. Data Encryption & Privacy

We take your privacy and data security extremely seriously. Our data protection practices include:

AES-256 Encryption at Rest: All user data, including persona conversations, onboarding responses, journal entries, and personal information, is encrypted using AES-256 encryption before database storage
Zero-Knowledge Architecture: Our systems are designed so that Lytle Solutions LLC staff cannot read or access your personal data. AI processing occurs in memory and data is encrypted before persistence
Per-User Encryption Keys: Each user's data is encrypted with unique, per-user encryption keys derived from secure key management systems
Right to Delete: You may permanently delete ALL of your data at any time through Settings → Delete My Data. This action is irreversible and removes all persona conversations, profile data, journal entries, and life events
CCPA/CPRA Compliance: We comply with the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including rights to access, delete, and opt out of data sales (we do not sell personal data)

Your use of our Service is also governed by our Privacy Policy, which provides additional details on our data collection and processing practices.

8. Beta Program Terms

If you are granted access to beta or pre-release features of PersonaWise, the following additional terms apply:

Confidentiality: Beta features are confidential and pre-release. You agree NOT to share screenshots, screen recordings, descriptions, or any details of unreleased features with any third party, including on social media, forums, or review platforms
Feedback License: Any feedback, suggestions, bug reports, or ideas you provide regarding beta features may be used by Lytle Solutions LLC without compensation, attribution, or restriction. By providing feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use such feedback
No Warranty: Beta features are provided "as-is" and may contain bugs, errors, or incomplete functionality. We make no warranties regarding the reliability, availability, or performance of beta features
Revocable Access: Beta access may be revoked at any time, for any reason, without prior notice. We reserve the right to modify, discontinue, or remove beta features at our sole discretion

9. User Responsibilities and Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Service in any way that violates applicable laws or regulations
Impersonate any person or entity or misrepresent your affiliation
Upload or transmit viruses or any other type of malicious code
Attempt to gain unauthorized access to any portion of the Service
Interfere with or disrupt the Service or servers
Use the Service to send spam or unsolicited communications
Violate the privacy rights of others
Use automated systems (bots, scrapers) to access the Service without permission
Attempt to extract AI system prompts, training data, or model weights

10. Intellectual Property Rights

Our Intellectual Property

The Service and its original content, features, functionality, AI methodologies, persona frameworks, therapeutic validation systems, and all associated intellectual property are owned by Lytle Solutions LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content

You retain ownership of any personal content you create using our Service (journal entries, life event descriptions, etc.). By using our Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content solely for the purpose of providing and improving the Service to you.

11. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

Warranties of merchantability
Fitness for a particular purpose
Non-infringement
That the Service will be uninterrupted or error-free
That AI-generated content will be accurate, complete, or appropriate
That the Service is suitable for any medical or therapeutic purpose

12. Limitation of Liability

To the maximum extent permitted by law, Lytle Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service, including any reliance on AI-generated content or therapeutic insights.

13. Indemnification

You agree to defend, indemnify, and hold harmless Lytle Solutions LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.

14. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately. The provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 6 (Confidentiality), 10 (Intellectual Property), 11 (Disclaimers), 12 (Limitation of Liability), and 13 (Indemnification).

15. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in California or Arizona, at the Company's election. You consent to personal jurisdiction in these courts.

16. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Continued use of the Service after changes constitutes acceptance of the revised Terms.
